Terms and Conditions
Bidder and Auctioneer agree that the terms listed below shall govern each online auction sale.
REGISTRATION: It is the sole responsibility of the bidder to provide a complete and accurate profile at the time of registration. All bidders must be 18 years old and provide valid credit card information at the time of registration. The McKinney Auction Company reserves the right to deny registration at it's discretion.
PAYMENT: By registering to bid and participating in our auction events, you agree to abide by the payment terms stated in the details of each Auction Event. If the bidder fails to comply with the payment terms stated in the event details, the invoice amount will be charged to the credit card on file for that bidder number. If the credit card is inactive or cannot be charged, ownership of the items won will revert back to the owner/seller of the item. If credit card is active and charges are made, the bidder will have 24 hours from time payment is made to pick up their items.
SALES TAX: All Sales are taxed according to state regulation.
TAX EXEMPT: It is the Bidder's responsibility to provide the appropriate resale or exemption certificate for each auction at which the Bidder makes a purchase.
AUCTION ITEM DESCRIPTIONS: All items are described and believe to be correct by the selling parties. Nevertheless, neither those descriptions nor any oral statements made by Owner/Seller or McKinney Auction Company concerning these items or lots shall be construed as a warranty either express or implied. ITEMS AND LOTS ARE SOLD AS IS - WHERE IS and WITH ALL FAULTS. Bidder acknowledges that all items and lots were available for inspection prior to the auction and, by these terms, The McKinney Auction Company and Owner/Seller encouraged Bidders to carefully inspect each item prior to bidding. THERE ARE NO WARRANTIES OF ANY ITEM SOLD.
WITHDRAWAL OF ITEMS: From time to time, it may become necessary to withdraw items from a sale after they are listed. The Mckinney Auction Company realizes this is an inconvenience and will not take this course of action lightly. However, we do reserve the right to remove items from the auction in the event the need arises.
REMOVAL: Once the auction is over, the buyer owns the item. The Buyer assumes all risk of damage and/or loss of the property until removed from sale premises. The pickup information is stated in each auction event's details. Bidders who fail to pick up items won by the removal deadline will incur storage fees in the amount of $25.00 per day per invoice, lose their bidding privileges.
ADJUSTMENTS: McKinney Auction Company reserves the right, for any reason, in its sole discretion, to terminate, change or suspend any aspect of the auction sale.
TERMINATION OF AGREEMENT: This Site User Agreement constitutes a binding agreement between Bidder and McKinney Auction Company until terminated by the McKinney Auction Company which may terminate this agreement at any time, without notice. If Bidder dissatisfaction occurs with the auction sale in any way, Bidder's only recourse is to immediately discontinue use of the auction Site. McKinney Auction Company reserves the right to terminate Bidder registration and use of the auction Site, and impose limits on certain features of the auction Site or restrict Bidder's access to, or use of, part or the entire Site without notice or penalty.
INTERRUPTION OF SERVICE: McKinney Auction Company is an online auction company. Due to the fact that we cannot control all aspects of electronic service, we cannot be held responsible for any interruption or service related this auction site. McKinney Auction Company may void any sale, temporarily suspend bidding and re-sell any items or lots that were affected by any malfunction. The decision of McKinney Auction Company is final.
PRIVACY: McKinney Auction Company gathers information about Bidders and Owner/Sellers for the purposes of conducting online auctions. Personal information will not be sold or distributed to other companies PERIOD.
WHAT IS A BID: When a bid is placed a contract is made. The bid is a binding contract between you and the Owner/Seller and the bid cannot be retracted. Once you place a bid and win, you are contractually required to buy the product at the said price you bid. Placing a bid on this Site, and winning, then not paying for the product is illegal in most states, and prosecution can result. McKinney Auction company also reserves the right to reject any unreasonable bid.
USAGE: By visiting this site, you agree that you will not copy or alter any electronic media residing on this site without the written consent of McKinney Auction Company. There are no warranties associated with the content placed on this site. All electronic media is the sole ownership of McKinney Auction Company and cannot be reproduced or marketed. Any attempt to do so will be considered a copyright violation and will result in legal action.
